TERMS AND CONDITIONS

These Terms and Conditions apply to all orders placed with BAKE BOX SWEETS (“Bakery,” “we,” “our,” or “us”). By placing an order, the customer (“Customer,” “you,” or “your”) agrees to the following terms.

These Terms and Conditions may be updated at any time to comply with applicable laws and regulations within the State of Colorado.

COTTAGE FOOD COMPLIANCE

BAKE BOX SWEETS operates under the Colorado Cottage Foods Act and complies with all applicable Colorado cottage food laws and regulations, including Colorado Revised Statute 25-4-1614 Home Kitchen Exemption requirements.

All products are prepared in a home kitchen that is not subject to state licensure or routine inspection.

Food Safety & Sanitation

At BAKE BOX SWEETS, we take cleanliness and food safety seriously throughout every stage of preparation and packaging.

During the baking and packaging process, we follow sanitation and safe food handling practices including:

  • Use of gloves and face shields when appropriate

  • Hair coverings and aprons during food preparation

  • Sanitized baking tools, equipment, and work surfaces

  • Proper handwashing and food handling procedures

  • Careful packaging and storage practices to maintain product quality and freshness

We strive to maintain a clean and safe baking environment in accordance with Colorado Cottage Food guidelines and general food safety best practices.

INGREDIENTS AND ALLERGENS

Our products may contain or come into contact with common allergens including, but not limited to:

  • Wheat

  • Dairy

  • Eggs

  • Soy

  • Peanuts

  • Tree nuts

We are not an allergen-free bakery and cannot guarantee that any product is completely free from cross-contact with allergens.

It is the Customer’s responsibility to notify guests and recipients of any allergen risks. BAKE BOX SWEETS shall not be held liable for allergic reactions or adverse effects resulting from consumption of our products.

All products are intended for consumption on the day of pickup or delivery unless otherwise stated. Customers are responsible for following all storage, handling, and consumption instructions provided.

QUOTATIONS AND PRICING

All quotes are valid for five (5) calendar days from the date issued unless otherwise stated.

Pricing is subject to change until:

  1. The order is confirmed,

  2. The invoice is issued, and

  3. The required deposit is received.

Custom pricing is based on design complexity, serving size, ingredients, packaging, delivery requirements, and production time.

ORDER REQUIREMENTS

We request a minimum of seventy-two (72) hours’ notice for most orders. Availability for short-notice orders is not guaranteed and may be subject to rush fees.

Orders are considered confirmed only after:

  • Written confirmation from both parties,

  • An invoice has been issued, and

  • The required deposit has been paid.

Customers are responsible for reviewing all order details, including spelling, colors, flavors, quantities, pickup dates, and design requests prior to final confirmation.

CUSTOM DESIGNS AND INSPIRATION PHOTOS

Products created from reference images, inspiration photos, Pinterest images, or examples from other bakers will be interpreted in BAKE BOX SWEETS’ artistic style and will not be exact replicas.

Certain designs, characters, logos, trademarks, or copyrighted materials may not be reproduced due to copyright or licensing restrictions.

We reserve the right to make minor design adjustments when necessary due to product structure, material availability, weather conditions, or artistic judgment.

DEPOSITS AND PAYMENTS

A non-refundable deposit equal to fifty percent (50%) of the total order amount is required to secure your order date and time.

Orders are not reserved until the deposit has been received.

The remaining balance must be paid in full on or before the scheduled pickup or delivery date. No products will be released until payment is received in full.

Failure to make final payment may result in cancellation of the order without refund of any monies previously paid.

DROP OFF POLICY

Customers are responsible for inspecting products at the time of pickup.

Once the order has been picked up and accepted by the Customer, BAKE BOX SWEETS is no longer responsible for any damage caused by transportation, handling, storage, weather exposure, or improper care.

Customers are responsible for transporting products safely and following all storage instructions provided.

DELIVERY POLICY

Delivery may be available within select service areas and is subject to availability and additional fees.

A delivery date, time, and location will be agreed upon in advance. Customers are responsible for ensuring someone is available to receive the order.

We allow a fifteen (15) minute grace period for customer arrival or contact. If no contact is made after this period:

  • The order may be returned to our premises, and

  • Additional delivery fees may apply for redelivery.

If the product is not retrieved within twenty-four (24) hours after a failed delivery attempt, the product may be discarded without refund.

Once delivery is completed and the order is accepted in good condition, responsibility for the product transfers fully to the Customer.

BAKE BOX SWEETS is not responsible for damage occurring after delivery due to weather, mishandling, improper storage, transportation, or acts beyond our control.

PRODUCT QUALITY AND LIABILITY

We make every effort to provide high-quality products and accurate designs.

Due to the handmade nature of baked goods, slight variations in color, decoration, size, or appearance may occur and shall not be considered defects.

BAKE BOX SWEETS is not liable for:

  • Damage occurring after pickup or delivery,

  • Allergic reactions,

  • Improper storage or handling,

  • Delayed consumption,

  • Melting or weather-related damage,

  • Injuries resulting from misuse of non-edible decorations or support structures.

Certain custom products may contain non-edible supports such as dowels, wires, toppers, or decorative elements. Customers are responsible for removing these items before consumption.

Our maximum liability for any claim shall not exceed the total amount paid for the affected product.

CANCELLATIONS, POSTPONEMENTS, AND REFUNDS

Postponements

If an event must be postponed, please contact us as soon as possible.

Transfer of payments to a new date is subject to availability. We cannot guarantee availability for rescheduled dates.

Customer Cancellations

If an order is canceled:

  • Deposits are non-refundable.

  • Any additional refunds are determined based on notice provided and expenses already incurred.

Refund eligibility is as follows:

  • More than thirty (30) days before the event date: refund of payments made beyond the deposit, minus any supplies or materials already purchased.

  • Seven (7) to thirty (30) days before the event date: partial refund may be issued at our discretion based on work completed and materials purchased.

  • Less than seven (7) days before the event date: no refunds will be issued.

Refunds, when applicable, will be processed within a reasonable timeframe after cancellation approval.

Bakery Cancellation

In the rare event that BAKE BOX SWEETS must cancel an order due to illness, emergency, unsafe conditions, supply shortages, or circumstances beyond our control, all payments received will be refunded. Refund processing times depend on the customer’s financial institution and are outside of our control.

REFUSAL OF SERVICE

We reserve the right to refuse or cancel orders for reasons including, but not limited to:

  • Harassment, abusive, or inappropriate behavior,

  • Conflicts in scheduling or availability,

  • Insufficient notice,

  • Non-payment,

  • Requests that violate copyright or legal restrictions,

  • Communication issues preventing accurate fulfillment of the order.

PHOTOGRAPHY AND PUBLICATION

We reserve the right to photograph and use images of our products for marketing, advertising, social media, website content, portfolios, and promotional materials unless otherwise requested in writing by the Customer before fulfillment.

FORCE MAJEURE

BAKE BOX SWEETS shall not be held responsible for delays, cancellations, or failure to perform due to events beyond reasonable control, including but not limited to:

  • Severe weather,

  • Natural disasters,

  • Power outages,

  • Accidents,

  • Illness,

  • Government restrictions,

  • Supply shortages,

  • Transportation disruptions.

AGREEMENT

By placing an order with BAKE BOX SWEETS, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
